Driver's Ed, Preschool Fees Called Illegal



     SIOUX FALLS, S.D. (AP) - The South Dakota Attorney General's
office says public schools that offer fee-based preschool and
driver education classes are breaking state law.
     Assistant Attorney General Bobbi Rank wrote in an opinion that the
law authorizes schools to charge for before- and after-school
programs, adult education classes, parking and busing. But no
statute gives schools permission to charge resident students for
voluntary preschool or driver education classes.
     Several school officials say they've stopped charging tuition as
a result of the decision and might have to eliminate the programs
next year unless the law is changed.
     Harrisburg Superintendent Jim Holbeck says a group of
administrators will push for legislation next session that would
give schools the authority to charge for those services.
