SIOUX FALLS, S.D. (AP) - A judge has ruled that city officials in Sioux Falls did nothing wrong when they annexed land for a planned Walmart supercenter.
A group of neighboring residents had sued the city, saying the land was illegally annexed in April because the city did not first seek approval from Lincoln County. City officials contended that wasn't necessary and the judge agreed.
Wal-Mart Stores Inc. issued a statement saying it was pleased with the ruling.
Save Our Neighborhood spokeswoman Dana Palmer says the group hasn't decided whether to appeal. She says that regardless, the group will continue to oppose the store.
The City Council is scheduled to vote Tuesday on rezoning for the new store.
