RAPID CITY, S.D. (AP) - South Dakota Attorney General Marty
Jackley says the state hasn't decided whether to appeal a judge's
order keeping the state's new abortion law from going into effect.
Jackley says that he wants Gov. Dennis Daugaard, the
legislature and his office to agree on a path forward after U.S.
District Judge Karen Schreier's June 30 order.
The law passed earlier this year requires women seeking
abortions to wait three days and undergo counseling to discourage
them from the procedure. Schreier said in her June 30 order that
the law violated women's constitutional rights to free speech.
Jackley, a Republican, says lawyers from his office will make a
recommendation by July 18 either to pursue an appeal or settle the
case out of court.
