SIOUX FALLS, S.D. (AP) - A Sioux Falls man accused of hitting
and killing a bicyclist after passing out at the wheel of his
pickup truck has been sentenced to serve about three months in
jail.
Judge Robin Houwman on Tuesday said a longer sentence for 43-year-old
David Bendt "would lead to the ruination of two families."
Authorities say Bendt was driving under the influence of
alcohol, antidepressant medication and muscle relaxants on Aug. 18,
2010, when he struck 49-year-old Kevin Rogers, who died at the
scene.
Bendt in July pleaded guilty to manslaughter and driving under
the influence, and prosecutors dropped other charges including
vehicular homicide. He was sentenced to serve 100 days behind bars
and complete 1,000 hours of community service.
