The man facing numerous charges in connection with a September 9th
fatal traffic accident is currently free on bond.
Bond for 39-year-old old John Auer was set this week at $50,000 cash.
That bond was posted and Auer is out of jail.
Conditions of Auer's bond include: He cannot drive, he must remain in
the custody of his mother, he must remain law abiding and he must fully
comply with the conditions of his aftercare set by the Human Services
Center.
Auer is charged with first-degree manslaughter, second-degree manslaughter,
aggravted assault, simple assault of a law enforcement officer, obstructing,
two counts of simple assault and reckless driving.
The charges stem from an accident that killed 67-year-old James Edward
Schroeder of Brookings. He was drivng a pickup that was hit head-on by a
pickup allegedly driven by Auer.
After his arrest, Auer was taken to the Human Services Center in Yankton
for a mental evaluation. States Attorney Clyde Calhoon says he was back in
court on Wedensday.
The most serious charge, first-degree manslaughter, carries a maximum
penalty of life in prison.
Auer is scheduled to have a preliminary hearing on October 4th.
