Slain Guard's Family Members to Testify

SIOUX FALLS, S.D. (AP) - A Sioux Falls judge is set to hear from
the family members of a South Dakota penitentiary guard killed in a
failed escape attempt Wednesday.
The pre-sentencing hearing for 49-year-old prison inmate Eric
Robert launches its third day Wednesday morning.
Judge Bradley Zell is weighing whether Robert should be
sentenced to death. Robert pleaded guilty in September to the
killing of 63-year-old Ronald Johnson on April 12.
Robert bashed Johnson with a pipe, covered his mouth with
plastic wrap and wore the dead man's uniform in the failed escape
attempt.
Robert said he wants to be put to death, but the state still has
to prove that the death penalty is warranted.
The hearing is expected to finish on Wednesday.
Two other men have also been charged with the killing.
