Inmate's Execution Set



SIOUX FALLS, S.D. (AP) — A 49-year-old inmate sentenced to death for his role in the killing of a South Dakota penitentiary guard will be executed in May.

Attorney General Marty Jackley said on Thursday that Second Circuit Judge Bradley Zell has issued a warrant of execution for Eric Robert. Robert is scheduled to be executed sometime between May 13 and May 19. The warden at the State Penitentiary will select the exact date.

Both the state Supreme Court and Gov. Dennis Daugaard have the authority to suspend the execution until their case reviews are complete.

Robert confessed to killing Ronald Johnson on April 12 in a failed escape attempt. Two other inmates are charged in Johnson's death — 49-year-old Rodney Berget and 47-year-old Michael Nordman. Both have pleaded not guilty and are awaiting trial.
