PIERRE, S.D. (AP) - A judge has rejected a defense request to suppress a psychological evaluation done on a Pierre teenager charged with murdering another teen.
Attorneys for 17-year-old Braiden McCahren believe psychologists went too far, delving into events surrounding the Dec. 18 fatal shooting of 16-year-old Dalton Williams. They say the evaluation was only to determine whether McCahren was a danger to himself or the community.
Prosecutor Michael Moore disagrees, saying no limitations were placed on the evaluation.
Judge John Brown on Thursday ruled that the evaluation can be used during a September hearing on whether McCahren's case should be transferred from adult court to juvenile court.
Brown did not rule out suppressing individual statements from the report in the future.
