PIERRE (10-10-26) — Attorney General Marty Jackley confirms that the Division of Criminal Investigation (DCI), at the request of the Minnehaha County Sheriff’s Office, is conducting an independent investigation into an officer involved shooting that occurred Friday, Oct. 9, in Sioux Falls.
The incident occurred at a Sioux Falls home Friday night. A Minnehaha County Sheriff’s Office deputy suffered critical injuries.
Brandon Oetken, 39, has been charged by the Minnehaha County State’s Attorney’s Office with three counts of Attempted First-Degree Murder of a Law Enforcement Officer and three counts of Aggravated Assault on a Law Enforcement Officer. He is presumed innocent under the U.S. Constitution.
DCI is leading the investigation into the use of force incident and is being assisted by the Sioux Falls Police Department.
Attorney General Jackley said the investigation will be thorough and transparent. DCI will issue a final report to be reviewed by the Attorney General to determine the officer’s use of force. The report’s release to the public is anticipated within 30 days.
This is the fifth Officer Involved Shooting in South Dakota this year.
