Dakotans for Health pursues second courthouse access lawsuit

Dakotans for Health, the organization seeking to put a couple of measures on the 2024 ballot, is suing a second county over courthouse access.

The group recently won a preliminary injunction against Minnehaha County and they’re now suing Lawrence County officials.

The group is seeking a Temporary Restraining Order, Preliminary Injunction, and Permanent Injunction to stop the county from enforcing petition circulation prohibitions that they say violate First Amendment rights.

Dakotans for Health is currently circulating petitions seeking to restore some abortion rights and eliminate the state sales tax on groceries.

The lawsuit claims current rules prohibit petition circulation and other First Amendment activity in and around the Lawrence County Administrative Office and adjoining buildings except for an unfrequented courtyard.
