SD Attorney General releases ballot explanation for measure to legalize marijuana

An explanation for a draft initiated measure that would legalize recreational marijuana has been submitted for public review by the South Dakota Attorney General’s Office.

This proposal would allow individuals 21 years old or older to possess, grow, sell, ingest, and distribute marijuana or marijuana paraphernalia. The measure does not change State laws concerning the State’s medical marijuana program.

State law requires the Attorney General draft a title and explanation for each proposed ballot measure.

The public now has 10 days to provide written comment on the explanation. The deadline is Monday, August 21st. The final explanation is due to the Secretary of State on Thursday, August 31st.

The measure would require 17,509 valid petition signatures to qualify for the 2024 general election ballot.
